A month and a half earlier, the International Criminal Court in The Hague indicted six prominent Kenyans for crimes against humanity relating to the post-election violence of ‘07-‘08 – one of those indicted was Joshua arap Sang, the leading presenter and head of operations of the popular Kalenjin language radio station Kass FM.</p>
<p>There is no immediate connection between them other than that they were journalists.  But they are linked by the continuing malign legacy of the Rwandan radio station Radio-Television Libre des Mille Collines (RTLM), active as an inciter of hatred and violence during the ‘94 genocide.  RTLM often referred to as Radio Machete, directly encouraged the genocide against the Tutsi people of Rwanda and the killing of moderate Hutus opposed to the extremists who launched the genocide.</p>
<p>The station broadcast in Kinyarwanda and French and called for the killing of the inyenzi, the word for cockroaches. Rwandans understood it to mean both supporters of Paul Kagame’s RPF and Tutsis in general.  Broadcasters at the station would call on all Hutus to protect themselves by killing Tutsis – locations of Tutsi refugees fleeing the genocide were broadcast along with names of people to be killed.<div class="warning" style="clear: both;">&nbsp;The rest of this post is only available to logged in users. <p>The prosecution has concluded its case in the trial of Thomas Lubanga Dyilo, alleged founder and leader of the union des patriotes congolais (UPC).</p>
<p>Lubanga Dyilo faced two counts of war crimes consisting of enlisting and conscripting children under the age of 15 years and using them to participate actively in hostilities in the Democratic Republic of Congo (DRC). The trial started on 26<sup>th</sup> Jan ‘09.</p>
<p>The defence is scheduled to start presenting its evidence in Oct ‘09. For over 22 weeks, during 74 days of hearings, the trial chamber heard 28 witnesses called by the office of the prosecutor, including three experts. The Chamber also called two other experts to testify. The defence team cross-examined all the witnesses presented by the prosecution.<br />
Twenty-five witnesses were granted protective measures. These measures included voice and facial distortion and the use of pseudonyms.</p>
<p>Two other cases relating to the situation in the DRC are being heard before the Court: The Prosecutor v. Germain Katanga and Mathieu Ngudjolo Chui and the Prosecutor v. Bosco Ntaganda. Both Germain Katanga and Mathieu Ngudjolo Chui<br />
are in the custody of the Court while Bosco Ntaganda remains at large.
