New Africa Analysis Ltd welcomes you to www.newafricaanalysis.co.uk. These are our terms and condition for use of the website. These terms and conditions apply whenever you access our online service, on whatever device.
By using the network, you are deemed to have accepted these conditions.
Some areas of newafricaanalysis.co.uk require subscription. By subscribing to any of our services, you are deemed to have accepted these terms and conditions.

1. Terms and Condition of Subscription
If you do not agree with any part of these terms and conditions do not place an order. If you have any questions please contact us at subscriptions@newafricaanalysis.co.uk
(A) Payment
The payment for your subscription will be handled by PayPal, whose registered office is PayPal (Europe) S.à r.l. & Cie, S.C.A. (“PayPal Europe”), 5th Floor, 22-24 Boulevard Royal,L-2449, Luxembourg

(B) When the subscription contract is formed
When you submit your order online, or you fax, post or telephone us with details of your order, you are making an offer to take out a subscription which if accepted by us, will result in a binding contract
Although you will either see a page or receive an email if you have supplied your email address acknowledging that your order has been received successfully and is being processed, the contract between us is not formed at this point. A legally binding contract is formed on the date we send you written confirmation of your order.
We reserve the right not to accept or process your order for any reason. If we do not accept your order and your PayPal account has already been debited, we will notify you and refund your card in full immediately.
We reserve the right not to fulfil and to cancel orders in the event of obvious inaccuracies in prices, except that we may fulfil your order at the correct price
(C) Delivery
If you have purchased a subscription for the hard copy of New Africa Analysis, we will deliver the magazines to the address you notify to us when you place your order. Orders purchased will start with the next available issue. You agree that we will not be responsible for failure to deliver the magazines if you have supplied us with an incorrect address. We reserve the right to dispose of incorrectly addressed envelopes and their contents without an obligation to refund you or any other person if they are returned to us and despite efforts to contact you we do not receive correct address details.
We will not be liable to you for any delay in delivery or non-delivery of magazines in the following circumstances:
(i) where PayPal refuses to authorise payment to us;
(ii) where such delay or failure is due to circumstances beyond our control or the control of our sub–contractors and agents, including but not restricted to war, electricity power failure, utilities failure, failure of telecommunications links, failure of transport infrastructure, fire, flood, government act, legislative constraints, strikes, labour disputes or malicious damage involving employees.
(D) Price Information
Prices displayed on the subscriptions section of the website will prevail at all times in relation to orders placed on-line. Prices quoted on screen include delivery charges and taxes (where applicable).
Although we try to ensure that all prices are accurate, errors may occur. If we discover an error in the price of your order, we will inform you as soon as possible. You will have the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. We will refund you in full if you cancel the order and have already paid.
(E) Third Party Rights
A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce or rely upon any provision of them.

The prices quoted in $ or € are an approximate figure.
(G) Other
When you subscribe to New Africa Analysis, you will receive a username and password from us to access otherwise restricted areas of the website.
We allow you to access these restricted areas of the site on the basis that:
(i) your username and password are personal to you and may not be used by anyone else to access newafricaanalysis.co.uk
(ii) you will not do anything which would assist anyone who is not a subscribed user to gain access to any registration area of newafricaanalysis.co.uk
(iii) you do not maliciously pass yourself off as another subscriber
(iv) you comply with these terms and conditions.
If, for any reason, we believe that you have not complied with these requirements, we may, at our discretion, cancel your access to the restricted areas of newafricaanalysis.co.uk immediately and without giving you any advance notice.
(H) Governing Law and Jurisdiction
These Terms and Conditions are governed by English law. You hereby irrevocably submit to the exclusive jurisdiction of the English courts notwithstanding the jurisdiction where you are based.
2. Termination of subscription
If the subscription should come to an end, we will email you at the address you have given us stating that the agreement has terminated. The agreement will terminate and your username and password will become invalid on newafricaanalysis.co.uk immediately.
3. Use of material appearing on newafricaanalysis.co.uk
For the purposes of this agreement, “material” means material including, without limitation, text, video, graphics, pictures and sound material, published on newafricaanalysis.co.uk, whether copyright of New Africa Analysis or a third party.
You may download and print extracts from the material and make copies of these for your own personal and non-commercial use only. You are not allowed to download or print the material, or extracts from it, in a systematic or regular manner or otherwise so as to create a database in electronic or paper form comprising all or part of the material appearing on newafricaanalysis.co.uk.
You must not reproduce any part of newafricaanalysis.co.uk or the material or transmit it to or store it in any other website or disseminate any part of the material in any other form, unless we have indicated that you may do so.
4. Disclaimer of liability

6. Submitting graphical material and photography for publication on newafricaanalysis.co.uk
If you send a photograph or other graphical material to us you do so in accordance with these Terms of service.
This means that you hereby agree that you have taken the photograph(s) you have sent to us or you have permission from or are authorised by the owner of the photograph(s) to send it (them) to us, and you are granting us a non-exclusive, royalty-free licence to publish or otherwise use the photograph(s) in any way and at any time we want on the newafricaanalysis.co.uk web site.
Selected photographs and graphical material will be published at the discretion of the editor and you will not be paid, even if your photograph(s) is (are) published.
We may cut, edit, crop or arrange your photograph(s) or graphic as we think fit to appear on the newafricaanalysis.co.uk web site, and we may remove your photograph(s) or graphics at any time.
IMPORTANT: You or the owner of the photograph(s) still own the copyright in the photograph(s) sent to us and are free to republish the photograph(s) wherever you or the owner wish and in whatever medium you or the owner want.

(v) you agree not to post material which is deliberately intended to upset other users
(vi) you acknowledge that any breach of these warranties may cause us damage or loss and you agree to indemnify us in full and permanently against any third party liabilities, claims, costs, loss or damage we incur as a result of publishing material you submit to us, including consequential losses.
(vii) we reserve the right to remove your access to individual services completely if we believe you are abusing the services in any way.
8. Data protection
We make sure that the data we collect from you (such as your username, password, email address) is safe and secure as stipulated under the Data Protection Act 1988.
9. Force majeure
Although we will do our best to provide constant, uninterrupted access to newafricaanalysis.co.uk, we do not guarantee this. We accept no responsibility or liability for any interruption or delay.
10. Governing law & jurisdiction
This agreement is governed by English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
